Any documents or emails outlining the status of the construction of the Gordie Howe International crossing created between April 1, 2021 and the date of the search. All internal policies, protocols and similar governing documents currently in place relating to the use of both official languages by WDBA. All meeting minutes and agenda packages for meetings of the WDBA Board of Directors and its committees, pertaining to the most recent completed fiscal year. Any electronic records (e.g. emails, memos etc.) created or received, as the case may be, from January 1, 2020 to the date of the search, relating to any legal proceedings in the United States of America.”

“All final reports outlining the status of the construction of the Gordie Howe International Bridge crossing created between April 30, 2021, and May 26, 2021, from the Enterprise Project Management Office (EPMO).”

“Pursuant to the Access to Information Act (the “Act”), we request copies of the following documentation, communications, and information relating to or pertaining to the above-referenced project (“Project”):[1]

  1. Any and all payment applications and/or estimates submitted by BNA Constructors USA JV for any and all work performed and/or labor, material, and/or equipment furnished by J. Ranck Electric Inc. and/or any and all of J. Ranck Electric Inc.’s subcontractors, as well as any and all documentation, communications, or information, whether in written or electronic form, relating to, evidencing, or pertaining to, the approval or denial and the payment of those payment applications or estimates;
  2. The payment and performance bonds that BNA Constructors USA JV was required to obtain and provide under the contract between the Windsor-Detroit Bridge Authority and BNA Constructors USA JV for the Project; and
  3. The payment and performance bonds that J. Ranck Electric Inc. was required to obtain and provide under the subcontract between BNA Constructors USA JV and J. Ranck Electric Inc. for the Project.

[1] For purposes of this request:

a. The term “documentation” shall mean and include any draft, original, and any non-identical copy (whether different from the original because of notes made on a copy or otherwise) of any document, whether written, printed, taped, recorded, computerized, photocopied, or otherwise produced or reproduced, that has been or is in your possession, custody, or control.  By way of illustration, the term “document” shall mean and include, but not be limited to, the following: advertising literature, agreements, bank records, blueprints, books, brochures, calendars, charts, checks, component lists, computer printouts, computer software, correspondences, data bases, disks, diskettes, drawings, e-mails, engineering specifications, films, graphs, invoices, letters, licenses, magnetically or optically stored computer data, manuals, maps, marketing plans, memorandums, minutes, models, newspapers or other clippings, notes, notebooks, objections, packing lists, periodicals or other publications, photographs, price lists, product specifications, prototypes, receipts, reports, schematics, sketches, statistical compilations, stenograph media, telegrams, telephone logs, teletexts, travel and expense records, video recordings, voice recordings, vouchers, and any other documentary material of any nature;


 b. The term “communications” shall mean and include any transmission of information by any means, including, but not limited to, telephone, mail, telegram, teletype, telex, telecopy, e-mail, computer linkup, inter-office mail, memorandum, note, or face-to-face conversation; and 


c. All of the documentation, communications, and information requested is to be produced in its native or original format.  Upon request, we will promptly provide the electronic medium (compact discs, portable drives, etc.) for production of the requested documentation, communications, and information if the native or original format of that information requested is electronic.“
